FDA’s Own Documents Show Cascade of Wrongdoing in Unconscionable Defense of Mercury Amalgams

Special message from Charles G. Brown, National Counsel, Consumers for Dental Choice:

Documents we continue to obtain from FDA under the Freedom of Information Act paint a picture of an agency that has engaged in wrongdoing -- and knows it.

1. While owning stock options in Henry Schein Inc., Commissioner Margaret Hamburg indeed did participate in the amalgam rule-making, presiding at a July 1 policy meeting “to secure feedback from the Office of the Commissioner” and to discuss the rule’s “next steps.” Having received over a million dollars for the easy lifting of being a corporate “director,” Hamburg repeatedly disregarded warnings to stop: the ethics contract she signed, an admonition from her financial advisor, and two letters from me.

2. Hamburg sidekick Joshua Sharfstein entered at the last minute to rubber-stamp the rule that covers up the mercury and conceals warnings of neurological harm to children and unborn babies that FDA had already agreed to. Sharfstein has become so knee-deep in this morass that just yesterday he cancelled a meeting with Congresswoman Diane Watson, who demands an explanation for such a horrible rule.

3. After Hamburg complained to her corporation that “there are constraints on my activities while I hold any interest in Schein,” Schein officials offered her a special favor -- they agreed to cancel the options before their expiration date (something that even Hamburg’s financial advisor had said was not possible) so that the Commissioner could start regulating Schein sooner. Hamburg agreed and the deal was signed on July 28 – the day the amalgam rule was announced.

4. Henry Schein benefited enormously from the rule, with its stock jumping $1.50. In an email exchange, the Commissioner “severed” her relationship to Schein (two days after the rule was announced), but assured Schein’s general counsel that she hoped her “friendships” at Schein “will outlast the period of my recusal.” In response, the general counsel noted that Schein is “indebted” to her for her “service” at FDA.

5. The Commissioner’s husband, Peter Fitzhugh Brown, was marketed to the American people as an “expert in artificial intelligence.” Actually, he is a hedge fund trader, an officer at Wall Street colossus Renaissance Technologies. Hamburg secretly enlisted Peter Brown into FDA’s inner circle to participate in FDA deliberations as to how to deal with the amalgam rule’s fall-out, where he could advise agency press aides and policy makers and be advised by FDA lawyers -- and get valuable insider information for his day job (an FDA Commissioner has a huge impact on stock values of major corporations). Renaissance Technologies traded $6 million in Schein stock during the second quarter alone.

C) Thirty-nine (39) Members of Congress, so far have signed onto the Watson-Burton resolution calling for FDA to disclose the presence and risk of the mercury. It’s House Resolution 648; check with your Representative to see if she or he has signed on yet.

FDA Commissioner Margaret Hamburg entered FDA through the revolving door from Henry Schein Inc., the nation’s #1 amalgam seller; participated in the rule-making despite a trio of warnings; corralled her staff into making false denials about it; cut a deal with benefactor Schein on the day the amalgam rule was announced; and brought a hedge fund trader dealing in Schein stock into FDA’s inner circle. Small wonder that Hamburg’s chief press henchman calls for an “end game” against those seeking to unmask the wrongdoing.

FDA’s Deputy Commissioner Joshua Sharfstein covers up mercury-neurological harm nexus

FDA Deputy Commissioner Joshua Sharfstein has given his seal of approval to major mercury exposure for millions of America’s children and unborn children – and to covering up both the neurological risks and the flawed rulemaking process.

Despite admitting that amalgam causes mercury exposure -- and despite knowing that mercury causes neurological harm to developing brains -- Sharfstein rejects putting on contraindications for amalgam, rejects putting on warnings on amalgam and evenrejects a requirement that dentists tell patients that amalgam is mainly mercury.

Sharfstein even withdraws FDA’s website warning that dental mercury can cause permanent neurological harm to children and unborn children. Sharfstein’s rule actually says FDA wants to stop a decline in amalgam sales. At Joshua Sharfstein’s FDA, commerce trumps safety.

When the Republicans ran FDA, to their real credit, they put this warning on the FDA website: “Dental amalgams contain mercury, which may have neurotoxic effects on the nervous systems of developing children and fetuses.” Upon assuming power, the Democrats withdrew this warning, covering up the fact that mercury from amalgam causes permanent harm to young children and kills unborn babies. Is this the change we Americans voted for?

Washington is famous for the revolving door -- those in the party out of power takes highly paid corporate positions, then returns to government to bail out their benefactors. The new FDA Commissioner, Margaret Hamburg, worked in the Clinton Administration, then went out and became a director at the dental products colossus Henry Schein, earning a quarter million dollars a year for the handful of hours it takes to be a director. Corporations do this because they know the other party will return to power, at which time the corporations will call in their chits.

Upon becoming Commissioner, Dr. Hamburg owned between $250,000 and $500,000 of Henry Schein stock. Certainly the Harvard-educated Hamburg knew the amalgam rule had the potential to affect her stock value. She could have done the right thing -- recuse herself from the rule. Instead, she worked on the rule for a while, then recused herself gradually, first by “deciding not to participate,” then finally “recusing.” Certainly her next-in-command, Deputy Commissioner, Joshua Sharfstein got the message that there was more at stake than good government.

On what date did Hamburg sell her Schein stock? What work did Hamburg do on the rule before she recused herself? What work did she do protecting amalgam from regulators while at Schein? Through her lawyer, Hamburg refuses to answer any of these questions. Ironically, Sharfstein heads a new a FDA “transparency task force.” A perfect first project would be to expose the Hamburg-Henry Schein links.

Joshua Sharfstein had the opportunity to protect children from amalgam, to save unborn babies and nursing babies from mercury exposure, and to warn us all that amalgam exposes us to toxic mercury. He came to Washington as a child advocate, but changed his stripes once he saw the revolving door game in action. Throwing his reputation out the window, Joshua Sharfstein chose to ally with the amalgam industry and cover up the mercury, turning his back on the children of America...

Just as Margaret Hamburg has embarrassed President Obama for bringing back revolving-door government, Joshua Sharfstein has embarrassed the President for deciding not to reduce the use of mercury in oral health care. If ever a President entered office as an inalterable opponent of mercury, it is Barack Obama, who wrote a law banning mercury exports and who is working for a treaty to phase out man-made mercury by a date certain. But at FDA, his appointee Sharfstein is sabotaging the President’s policies by hiding the mercury from Americans and hence keeping amalgam sales going into the indefinite future.

FDA doesn’t even defend its rule on the science. FDA admits it does not know if mercury fillings are safe for children six and under, or for nursing mothers whose mercury goes through the breast milk, or for pregnant women whose dental mercury No, it’s not science -- it’s about commerce. FDA wants Americans to keep buying amalgam.

The children of America have lost. Another generation will be mercury toxic.

Need further evidence on who won? Just yesterday (Aug. 5), Henry Schein’s CEO Stanley Bergman offered this salute to Dr. Hamburg:

"I would like to extend on behalf of the company, our Board and our shareholders our sincere thanks to Dr. Margaret Hamburg, who has served as the Director of Henry Schein Company's Board since 2003. Dr. Hamburg left our Board following her confirmation as Commissioner of the U.S. Food and Drug Administration. We would like to thank Dr. Hamburg for the insight she shared with the Henry Schein Board throughout the years and wish her continued success."

Hamburg claims she broke her ties with Schein three months ago. But Schein’s CEO issues his thank-you the day after the FDA rule was published in the Federal Register. Margaret Hamburg may not be in the hip pocket of Henry Schein Inc, but Schein’s CEO sure thinks she is. And he has the evidence to show it: a rule that allows Schein to sell amalgam to anyone, a rule that covers up the mercury, a rule that contains propaganda to be used by Schein to defend against the upcoming class action suits.

FDA bans mercury in all veterinary products. The new FDA, under Margaret Hamburg and her Sancho Panza, Joshua Sharfstein, have decided that children don’t merit the protection FDA gives horses and dogs.

(2) Why did you Democrats withdraw FDA’s website warning that dental mercury can cause neurological harm to children and unborn children, which the Republican Commissioner agreed to last year?

FDA's Toxic Teeth Removed? You Must Be Mad as a Hatter...

Headline: Mercury teeth fillings may harm some: FDA "Dental amalgams contain mercury, which may have neurotoxic effects on the nervous systems of developing children and fetuses," the FDA said in a notice on its Web site.

This may be the century's biggest "Moment of Duh." It took them how long to finally figure out that mercury in the mouths of babes is a dangerous thing? Should we increase their budget as a reward?

"The FDA must issue the new rules in July 2009," FDA spokeswoman Peper Long said.

Charles Brown, a lawyer for one of the groups called Consumers for Dental Choice, said the agency's move represented an about-face.

So it will take them an additional year to determine what to do with this "new" information. Does FDA need another billion tacked onto its already-bloated budget so that it may act on what was obvious to anyone with a lick of common sense over 100 years ago?

"Gone, gone, gone are all of FDA's claims that no science exists that amalgam is unsafe," Charles Brown said in a statement.

How sad is it that the ADA no longer has a rock to hide under? For the millions suffering mercury toxicity thanks to modern dentistry, not very.

"There's no science to support the danger of mercury in a filling!"

That's usually the cry from dental mercury "denialists" so that they may remain safely under the rock that is no longer there. Now that they are forced to crawl out and face the mercurial music, what happens next? The karmic loop takes its course. However, in an ideal world, it shouldn't have to take a lawsuit to force the FDA to do its job. Have you noticed that the veil of illusion is lifting on a lot of government denials recently? Another recent court case forced the feds to acknowledge a vaccine-autism link. Has Hell frozen over?

What of the individuals within the bureaucracy? Considering the bureaucrats that played along with the "see no evil, hear no evil" mercury defense, is it ever justifiable to defend the indefensible just to keep your job? Perhaps they should study Nuremburg. Inevitably, the federal government will shrink significantly, whether Ron Paul is around or not, simply because the Law of Cause and Effect is closing in. Dr. Paul is suggesting that we change course BEFORE it is devastatingly forced upon us all.

The FDA is charged with protecting the public from dangerous substances. How dangerous do you have to be to get banned around here?

"J.P. Morgan Securities Inc. analyst Ipsita Smolinski said the FDA is not likely to outright ban the fillings next year but will probably call for restrictions."

Got mercury? Even in the face of overwhelming evidence, much less common sense, the FDA will continue to allow dentists to install toxic metals into the mouths of trusting patients. What if dental amalgams were a dietary supplement rather than a medical device? The FDA tends to argue "pro-choice" only when the choice is exclusively pharmaceutical.

You noticed that they did not allow the American consumer the freedom to ingest ephedra -- even though it had only caused a handful of adverse events, none neurodegenerative, didn't you? In the case of dietary supplements, the FDA's weight is thrown 100% behind "safety" over freedom. When it comes to drugs and medical devices causing death, the feds will argue that you should have the freedom to choose it even though it may be deadly. That's a deadly, unconstitutional double standard.

"Only 30 percent of fillings given to patients were mercury-filled ones as of 2003, according to the American Dental Association (ADA)."

Who were the 30%? The poorest and most vulnerable among us were likely never given the option to choose a safer filling. The argument FDA makes for keeping toxic teeth available is that "the consumer should have a choice." Funny how that "choice" is never given equal consideration if the substance in question happens to be natural and non-pharmaceutical. Attention FDA dunderheads:

"If a substance is toxic, it is doubly toxic to those most nutritionally-deficient."

The claim that they "only want the poor to have an option" is a poor option, unless they take pleasure in increasing degenerative diseases among those economically-challenged in the inner-cities. Dental mercury is indefensible. Sometimes it just takes a while for the truth to filter through an obscenely large bureaucratic oligarchy. You want to make the FDA bigger? You'd have to be mad as a hatter...
